Please note, the U.S. Court of Appeals for the Second Circuit recently issued an important new fair use opinion in Bill Graham Archives v. Dorling Kindersley Limited (May 9, 2006), holding that the use of reduced-size reproductions of concert posters, in a colorfully illustrated reference book, was a fair use. Thus any use of copyrighted images on this website should fall within fair use since they are reduced not only in size but also resolution.

Also in Bridgeman Art Library v. Corel Corp. (Feb. 26, 1999) the U.S. Court of Appeals for the Second Circuit concluded that photographic reproductions of artwork whose copyright had expired could not themselves be protected by copyright law since they were mere copies of the underlying public domain artwork. In other words, a 500 year old artifact cannot be protected by copyright law and thus any reproduction of the artifact, either photographic, digitization, rubbing, drawing, etc.can also not be protected by copyright law and are part of the public domain. Thus all historical images on this website would fall under this category.
